Commissioners settle lawsuit

On July 13, the Lucas County commissioners settled a lawsuit filed four years ago following an arrest.

Timothy McGovern filed a suit against Lucas County, the commissioners, corrections officers and sheriff alleging assault, battery and negligence. According to court records, Mr. McGovern was arrested by a Toledo police officer November 10, 2017 for operating a vehicle under the influence and booked into the county corrections center.

An incident occurred in the holding cell at about 5:30 a.m. between Mr. McGovern and a corrections officer which resulted in the defendant suffering “bruises and cuts to his forehead and elbow, and he later was diagnosed with post-concussion syndrome,” according to records.

The commissioners subsequently settled the litigation, agreeing to pay the plaintiff $70,000 in exchange for a complete release of all claims.
